1. Orders

We make every effort to ensure that the products, prices, descriptions, and availability displayed on our website are accurate. However, flowers and floral products are seasonal and subject to availability.

An order is not considered accepted until it has been received and confirmed by us. We reserve the right to refuse, cancel, or modify an order when necessary, including when:

• A requested flower, plant, container, or other product is unavailable.
• The delivery address is incorrect or outside our service area.
• There is an error in the product description or price.
• We are unable to fulfill the order for circumstances beyond our reasonable control.
• There is a suspected fraudulent or unauthorized transaction.

If we cancel an order after payment has been received, we will provide an appropriate refund to the original payment method.

2. Floral Substitutions

Flowers are natural, seasonal products and availability can change without notice. The actual flowers, foliage, containers, or other materials used in an arrangement may occasionally differ from those pictured on our website.

When necessary, we may substitute flowers or other materials with items of equal or greater value, while making reasonable efforts to preserve the overall style, color scheme, size, and value of the arrangement ordered.

The container, vase, basket, ribbon, or other decorative element may also be substituted with a comparable item when the original item is unavailable.

3. Product Images

Product photographs displayed on our website are intended to provide a general representation of the product. Because floral arrangements are individually designed and flowers are natural products, the arrangement you receive may not be identical to the photograph.

Differences in flower varieties, color, size, seasonality, arrangement style, and containers may occur.

4. Delivery

We provide local delivery to designated areas surrounding Wilmington, OH.

Delivery dates and requested delivery times are estimates unless a specific delivery time has been expressly confirmed by us. While we make reasonable efforts to meet requested delivery dates and times, circumstances such as weather, traffic, holidays, high order volume, incorrect addresses, recipient availability, or other unforeseen circumstances may affect delivery.

The customer is responsible for providing an accurate and complete delivery address and any information reasonably necessary to locate the recipient.

Recipient Availability

If the recipient is not available when delivery is attempted, we may:

• Leave the order in a reasonably safe location;
• Leave the order with another responsible person at the delivery location;
• Contact the recipient to arrange delivery; or
• Return the order to our shop for later delivery or pickup.

Additional delivery charges may apply when a second delivery attempt is necessary due to an incorrect address, recipient unavailability, or other circumstances for which the customer is responsible.

For deliveries to businesses, hospitals, funeral homes, schools, hotels, apartment buildings, or other facilities, the order may be delivered to a receiving area, front desk, reception area, mailroom, or other designated location rather than directly to the intended recipient.

5. Same-Day Delivery

Same-day delivery may be available for orders placed before our posted daily cutoff time and within our designated delivery area.

Same-day delivery availability may vary based on holidays, weather, inventory, delivery volume, and other circumstances.

Orders placed after the posted cutoff time may be scheduled for the next available delivery date.

6. Pickup Orders

Customers selecting in-store pickup are responsible for collecting their order during our posted business hours or during the pickup window communicated by us.

Customers should provide accurate contact information so that we can notify them when their order is ready.

Orders that are not collected within a reasonable period may be subject to cancellation, additional arrangements, or other applicable charges.

7. Payment

Payment must be made using an accepted payment method at the time an order is placed unless otherwise agreed by us.

By submitting payment information, you represent that you are authorized to use the payment method provided.

We reserve the right to verify payment information and to cancel orders associated with suspected fraudulent or unauthorized transactions.

8. Prices and Taxes

Prices displayed on our website are subject to change without notice.

Applicable sales tax and other required charges will be added to orders as required by law.

Delivery charges, service fees, or other applicable charges will be disclosed during the ordering process whenever reasonably possible.

9. Cancellations

Cancellation requests should be submitted as soon as possible by contacting 937-382-1662 or orders@swindlerandsons.com.

Because floral arrangements are often custom-made and may involve perishable products, cancellation may not be possible once an order has entered production, been prepared for delivery, or been delivered.

If an order can be cancelled before preparation or delivery, we will determine the appropriate refund based on the circumstances.

Orders for holidays, special events, weddings, funerals, or other custom arrangements may be subject to different cancellation terms that will be communicated to the customer at the time of ordering.

10. Returns and Refunds

Because flowers and other floral products are perishable, we generally cannot accept returns of delivered floral arrangements.

If you are dissatisfied with an order, please contact us as soon as possible after delivery, preferably within 24 hours, so that we can review the issue and determine an appropriate resolution.

Depending on the circumstances, we may offer:

• A replacement arrangement;
• A partial or full refund;
• Store credit; or
• Another reasonable resolution.

Requests for refunds or replacements may require photographs of the delivered product.

Refunds, when approved, will generally be issued to the original payment method.

11. Damaged or Incorrect Orders

If your order arrives damaged, substantially different from what was ordered, or with another significant problem, please contact us promptly at 937-382-1662.

We will make reasonable efforts to correct legitimate problems with an order.

Claims made after an unreasonable period of time may not be eligible for replacement or refund because flowers are perishable products.

12. Special Events and Custom Orders

Wedding flowers, funeral arrangements, event flowers, large orders, custom designs, and other specialty orders may be subject to additional terms, deposits, payment schedules, cancellation policies, and deadlines.

Those terms will be provided to the customer separately when applicable and will supplement these Terms & Conditions.

13. Customer-Provided Information

You are responsible for ensuring that all information submitted when placing an order is accurate and complete, including:

• Recipient name;
• Delivery address;
• Apartment, suite, or unit number;
• Business or facility name;
• Recipient telephone number;
• Delivery instructions; and
• Requested delivery date.

We are not responsible for delays, failed deliveries, or additional delivery charges resulting from incorrect or incomplete information supplied by the customer.

14. Gift Messages

Gift messages submitted with an order should be appropriate for the intended recipient.

We reserve the right to refuse to include content that is unlawful, threatening, abusive, obscene, defamatory, or otherwise inappropriate.

15. Website Content

The content of this website, including text, photographs, graphics, logos, product descriptions, and other materials, is provided for general informational and commercial purposes.
